While it is true that California is an at-will employment state -- meaning that employers and employees can end their employment relationship for almost any reason -- there are still contexts in which firings or layoffs may be found to have resulted from unlawful reasons.
Was there a Pattern of Age Discrimination?
Often, to determine whether a job termination was unlawful, an in-depth investigation of employment practices in the workplace is necessary. Was everyone who was laid off close to qualifying to collect retirement benefits? If so, age discrimination may be demonstrable. When an entire department was closed, and the employer reopened another, similar one under a different name, there may be a clear and discernible strategy of age discrimination at work.
We Ask the Right Questions
Our experience representing people who have been victimized through wrongful discharge or termination has given us an array of tools that we use to our clients' benefit. We understand the importance of conducting a thorough investigation and asking the right questions when speaking with current or former employees following a layoff or firing.
You May be Entitled to Severance Pay and Other Compensation
Ask us about your legal rights to severance pay, unemployment benefits, or compensation for breach of contract, after you were laid off. We have helped many employees obtain settlements after they were fired under questionable circumstances, such as retaliation for whistleblower activity or as a result of discrimination based on race, religion, or gender.
We represent employers as well as employees.
Contact a wrongful termination lawyer to schedule a consultation if you were discharged and suspect that your firing was a form of retaliatory discharge -- or if your former employee now claims that his/her termination was wrongful or unlawful. Se habla español.
