Negligent Security – Bar Fight Attorney

Have you been injured in a fight at a bar, nightclub, or other public establishment? Has a bouncer or other security personnel used unnecessary force and caused you physical harm? If so you should contact a negligent security attorney as soon as possible. Property owners have a legal responsibility to ensure the reasonable safety of customers and guests. If you have been injured on someone else's property you have a right to recover compensation from the owners for your medical expenses and other damages. The experienced negligent security attorneys at Lederer & Nojima will protect your legal rights and aggressively pursue those responsible for your injuries.

What Is Negligent Security?

In California, property owners have a duty to provide a safe environment for customers, guests, and invitees to their property and can be sued if someone is hurt because of the property owner's negligence or carelessness (for example failure to clean up a spill in a grocery store isle in a timely manner creates liability if a customer slips and falls). This is called "premises liability." One type of premises liability addresses the situation where a customer or guest is injured by a third party (for example someone starts a fight with you at a bar). This is called "negligent security" and the property owner can be sued if he or she failed to provide reasonably safe and secure conditions. The property owner may be held responsible for attacks, assaults, robberies, rapes, murders, and other crimes committed by a third party that results in injury to a guest or customer of the property owner. Negligent security claims may arise in any number of ways. Some of the most common examples include the following:

  • inadequate lighting and surveillance
  • inadequate security measures (such as inadequate locks, fencing, equipment, etc.)
  • malfunction of security equipment
  • security guard negligence
  • negligent hiring of security personnel

Injuries Related To Security Personnel

Patrons of bars, nightclubs and other public establishments have often been injured by bouncers or security guards that become overly aggressive while doing their job. In these instances, the property owner is liable for the acts of their security personnel who cause injury. The property owner can also be liable if they hired someone that they knew, or should have known, had violent propensities or had a record of violent crimes (this is termed "negligent hiring"). Concerning security personnel, property owners can be liable in any of  the following ways:

  • an attack or overly aggressive handling by security
  • insufficient number of security (the property owner should have had more security guards or bouncers on the premises to prevent trouble)
  • security personnel negligence (a security guard who falls asleep while on duty).

Negligent Security Attorney

Many customers of bars, nightclubs and other public establishments have been injured in fights and other incidents involving a third party because the property owner failed to provide adequate security measures. If you or a loved one has been injured, harassed, assaulted, or robbed at a public establishment, you may be able to file a claim against the property owner. At the Law Offices of Lederer & Nojima, our skilled injury attorneys will help you recover the compensation that you deserve. Call Lederer & Nojima today for a free case evaluation.
